la política de seguridad nacional es un punto clave en la permanecía de los gobiernos y estabilidad de los Estados, porque es mediante la articulación e instrumentalización de ésta que es factible, por un lado, estructurar un cuerpo legal y, por otro, un aparato discursivo que brinde un sustento ideológico. El discurso sobre el uso legítimo de la violencia para preservar la estabilidad y la supervivencia del Estado no sólo sigue siendo vigente, cada vez se afianza más gracias al marco jurídico que legaliza su dominación para proteger su estabilidad política y argumentar que lo que hace es salvaguardar la vida de los individuos. Partiendo del supuesto de que el Estado es una organización al servicio de las necesidades sociales, entonces el marco institucional se tendría que orientar a atender las demandas de la sociedad; no obstante, en la Ley de seguridad interior se pueden visualizar dos elementos que van en contra de esta idea: el establecimiento de un Estado de excepción y el derecho de vida y muerte. Por tanto, el objetivo de este artículo es evidenciar la relación existente entre la soberanía y el poder que tiene el Estado para establecer las políticas de seguridad nacional y por tanto para establecer los mecanismos que legitiman la Ley de seguridad interior.

national security policy is a key point in the permanence of governments and continuity of states, because it is through the articulation and instrumentalization of this that it is feasible, on the one hand, to structure a legal body and, on the other hand, a discursive apparatus that provides an ideological support. The speech on the legitimate use of violence to preserve the stability and survival of the State, not only is it still valid, each time it secures itself thanks to the legal framework that legalizes its domination to protect its political stability and claim that what it does is safeguard the lives of individuals. Starting from the assumption that the State is an organization at the service of social needs, then the institutional framework should be oriented to the demands of society; However, in the Law of Internal Security, the elements that go against this idea can be visualized: the establishment of a State of exception, and the right to life and death. Therefore, the objective of this article is to demonstrate the existing relationship between sovereignty and the power that the State has to establish National Security policies and to establish the mechanisms that legitimize the Internal Security Law.
